On February 8, the high court issued a restraining order against MGM Healthcare, preventing them from proceeding with the Unauthorised Building Construction of a multi-speciality hospital on St Mary’s Road in Alwarpet. The basis for this action was the hospital’s failure to obtain mandatory clearances for the construction.

Resident’s Complaint Triggers Legal Action
The court’s decision stemmed from a plea filed by senior advocate G Rajagopalan, a resident of the affected area. Rajagopalan raised concerns about the disturbance caused by excessive noise during the night, primarily due to piling work at the construction site.
Corporation’s Role in Oversight Questioned
During Monday’s hearing, the bench expressed astonishment. The hospital had commenced construction in July 2023 without CMDA’s prior permission. The additional government pleader clarified that monitoring Unauthorised Building Construction in the city was the responsibility of the Greater Chennai Corporation.
Court Takes Action: Corporation Commissioner Implicated
In response to this revelation, the bench suo motu included the Corporation Commissioner as a party respondent in the case. The commissioner is now required to file a comprehensive report detailing the steps taken by the corporation against Unauthorised Building Constructions in the city.
TNPCB Instructed to Monitor Noise Pollution
Additionally, the court directed the Tamil Nadu Pollution Control Board (TNPCB) to submit a report. The report should outline measures to monitor noise pollution during construction activities. The hearing has been adjourned to February 27, allowing the concerned parties time to provide the required reports.
