High Court Exercised Power given under Article 226 to Rescue Minor from Bangladesh: A minor kidnapped girl was rescued from Bangladesh with the effort of the Kolkata high court. By exercising of the jurisdiction which was enshrined under article 226 of Indian Constitution and which
has been very rarely seen. A writ petition was filed by the mother of the minor girl aged about 16 years who was kidnapped and trafficked to Bangladesh and was finally rescued by the Kolkata High Court.
The court stated that human trafficking inflicts a devastating blow to the life and liberty of the victim enshrined under article 21 of the Indian constitution. High Court also appreciated the co-operation and promptly took steps by the high commission of India at Dhaka and the high Commission of Bangladesh at Kolkata. The Court further elaborates that the jurisdiction given under article 226 by the constitution is wider than the Supreme Court. It has some responsibility to protect the fundamental rights of the citizens. Court has exercised jurisdiction under article 226 from time to time in a different manner to protect the life and liberty of the citizens. The courts noted that this decision will set a precedent for those who feel hopeless and tied down by the situations and lack of availability of perfect measures. (Iti Pandit Vs Union of India)
