PEOPLE NEED TO SHOW TOLERANCE TO OTHER RELIGION: Madras high court while dealing with a writ petition filed by a Hindu man on the ground of nuisance due to the use of loudspeakers throughout the day and night, by constructing a church. The permission has been granted by the Kanyakumari District Collector. Against which the petitioner filed a writ petition before the Madras High Court where it has been upheld by the high court that the preamble of our constitution says that “we the people” had resolved to constitute India as a Secular and democratic Republic country and the reference has been made by the article 15(1) which says that the state should not discriminate against anyone on the basis of religion, race, cast, etc. Article 25 says that all persons get the freedom of conscience and the right to profess, practice, and propagate any religion of their choice. And it is a fundamental duty of every citizen under Article 51A(e) to promote harmony and brotherhood among all.
The high court observed that the country named India takes the pride in Unity in Diversity; there cannot be diversity in unity. The petitioner should learn to maintain harmony with everybody else around him. India is a secular country the petitioner cannot make a complaint against the same.
Court also observed that it is prudent to show restraint and that the use of loudspeakers may not be required for the god to hear the prayers. “Let the prayers be conducted in a gentle manner”
