Split verdict for corruption to Dairy Development Minister K T Rajendra Balaji

In a rare disagreement, a division bench from Madras High Court on Thursday issued a split verdict for corruption to Dairy Development Minister K T Rajendra Balaji, with a judge who called it unnecessary and another favors the FIR. This problem has now been referred to the chief justice of HC to be sent to a third judge.

The accusation against the minister was that he had gathered unaccounted wealth with his income from his time as Vice President of Tiruthangal Panchayat City in the Virudhunagar district in 1996.
DVAC to register a First Information Report,
While justice M Sathyanaranyanan directed DVAC to register a First Information Report, Justice R Hemalata said he did not find the case of the prima facie against him guaranteeing FIR. “Further action, in this case, will not serve useful goals and it is just like whipping dead horses,” he said and dismissed the PIL.
Writ of public interest litigation that accused the minister
Given the absorbent sequence, this case has now been forwarded to the Chief justice of HC for the appropriate action.
It all began in 2013 when R Mahendran submitted a Writ of public interest litigation that accused the minister after stating that he did not have a known source of income and that he had not even obtained income tax when he applied for the State assembly election in 2011.

Conversely, in the same declaration, the minister claims to have several mobile assets and do not move, the applicant accused. Therefore, he wants the court to direct DVAC to register firmly against the minister based on his complaint and investigate this case.
Prima Facie to register FIR
During the hearing, DVAC submitted a 754-page report in preliminary investigations‘ and gave a clear note for the minister. It was concluded that the Prima Facie was no case carried out on the minister to register fIR.
Minister has done a cognizable offense
A detailed investigation conducted by DVAC was only a preliminary investigation and does not conclude whether the minister has done a cognizable offense or not, so the bench rejected the decision of the application to be dismissed.

The court wondered how DVAC could expect the court to bring down all the processes based on complete investigations carried out without registering an FIR.
